1. Your Personal Data
(a) personal information, which is any information or combination of information that exclusively identifies you such as your name passport or other identification number, date of birth, telephone number(s), mailing address, e-mail address and any other information relating to you which you have provided us in any forms you may have submitted to us, or in other forms of interaction with you;
(b) information about your use of Fuvay’s Website, Mobile Application and services, including cookies, IP address, subscription account details and membership details, but only to the extent that Fuvay may identify you from such information;
(c) your payment related information, such as your bank account or credit card information, and your credit history; and
(d) information about your usage of and interaction with our Website, Mobile Application and/or services including computer and connection information, device capability, bandwidth, statistics on page views, and traffic to and from our Site.
2. Collection of Personal Data
2.1 When you use the Website and/or the Mobile Application and/or purchase the Product from Fuvay’s stores and/or Carts, you provide us with certain Personal Information, such as your name, your email address and any other information that you provide to us.
2.2 When you use the Website and/or Mobile Application, you may set up your account. We collect this information so that we can provide you the Product (defined in Clause 2.1 of the Terms and Conditions).
2.3 Generally, Fuvay collects your Personal Data in the following ways:
(a) when you submit forms relating to any of our products or services;
(b) when you register for or use any of our services on Websites and/or Mobile Application’s owned or operated by us or when you register as a member of Websites and/or Mobile Applications owned and operated by us, or use services on such Websites and/or Mobile Applications;

(d) when you use some of our services;
(e) when you establish any online accounts with us;
(f) when you request that we contact you;
(g) when you are contacted by, and respond to, our marketing representatives and agents;
(h) when you respond to our request for additional Personal Data;
(i) when you ask to be included in an e-mail or other mailing list;
(j) when you respond to our promotions or other initiatives;
(k) when you submit a job application or scholarship application;
(l) when you submit your Personal Data to us for any other reason.

3.2 We do not sell or share your Personal Data with unrelated third parties for their direct marketing purposes.

Fuvay uses “cookies”, where a small data file is sent to your browser to store and track aggregate information about you when you enter our Website. The cookies are used to track information such as the number of Users and their frequency of use, profiles or Users and their preferred sites.
Fuvay may use an independent company (the “ Third Party Market Research Company”) to measure and analyze the Internet usage across the Website. Fuvay uses the Third Party Market Research Company’s services to collect the following core information on the usage of the Website, including, but not limited to:
(i) the number of page views (or page impressions) that occur on the Website;
(ii) the number of unique visitors to the Website;
(iii) how long these unique visitors (on average) spend on the Website when they do visit; and
(iv) common entry and exit points into the Website.
This information is aggregated by the Third Party Market Research Company and provided to Fuvay to assist in analyzing usage of the Website. Such data is also accessible by media organizations and research companies, for the purpose of conducting industry comparisons with other Internet portals.
Pages on the Website may be coded with software, which enables Third Party Market Research Company to track visitors to the Website.
Should you wish to disable the cookies associated with these technologies, you may do so by changing the setting on your browser. However, you may not be able to enter certain part(s) of the Website.

5. Withdrawal, Access and Correction of your Personal Data
5.1 You may withdraw, modify and correct Personal Data provided directly to Fuvay in connection with the services, if necessary. Fuvay offers Users the following options for updating information:
(a) send an e-mail to the e-mail address provided in our Terms and Conditions; or
(b) Users may edit and/or delete their Personal Data at any time by logging into their User Account on the Website and/or the Mobile Application or through Fuvay’s interactive voice recording. When doing so, Users will be requested to enter their password when prompted for verification purposes before their Personal Data is edited and/or deleted. With regards to information not available for change by Users, Users must send an e-mail to Fuvay to request for the specified changes to be made to their Personal Data. Upon receipt of a request, Fuvay may request Users to provide Personal Data for verification purposes. Fuvay will respond to Users’ requests within thirty (30) days.
5.2 Please note that if your Personal Data has been provided to us by a third party, you should contact such party directly to make queries, feedback, and access and correction requests to Fuvay on your behalf.
5.3 Please note that if you withdraw your consent to any or all use of your Personal Data, depending on the nature of your request, Fuvay may not be in a position to continue to provide its products or services to you or administer any contractual relationship in place, and this may also result in the termination of any agreements with Fuvay and your being in breach of your contractual obligations or undertakings, and Fuvay’s legal rights and remedies in such event are expressly reserved.

6.1 The security and confidentiality of your Personal Data is extremely important to us. 8. Governing Law
8.2 These Terms and Conditions and all matters relating to your access to, or use or, the Website, Mobile Application Product and services provided in relation thereto shall be governed by and construed in accordance with laws of the Republic of India without giving effect to any principles of conflicts of law.
8.3 All disputes, controversies, or differences arising out of or in connection with these Terms and Conditions shall first attempted to be resolved by mutual discussion between the User and Fuvay. Fuvay and you agree to participate in the mediation in good faith and undertake to abide by the terms of any settlement reached.
8.4 In the event that you and Fuvay are unable to resolve any dispute, controversies or differences after attempting mediation, the dispute, controversy or difference shall be referred to and finally resolved by arbitration in Fatehgarh Sahib in accordance with the Arbitration and Conciliation Act, 1996.
